This position is responsible for the overall management of Amtrak’s internal personal injury and property damage claims function for the offices and staff identified above, including without limitation: their structure, organization, staffing, internal leadership, locations of field offices; operations and policies, processes, protocols, practices with respect to claims handling and disposition; training and process assurance; budget and budget management; interface and coordination with in-house and outside counsel; management of and policies and practices concerning other vendors and program partners (including medical management and support resources); and results and effectiveness for the company.


• Directs and supervises four (4) Claims Managers and their six (6) offices and staffs in their management and handling of Amtrak’s internal personal injury and property damage claims functions, including without limitation, their structure, organization, staffing, internal leadership, locations of field offices, operations, policies, processes, protocols, practices, training, budget and budget management, interface and coordination with its in-house and outside counsel and other vendors and partners (including medical management resources), results and effectiveness for the company for their respective regions and types of claims.
• Working with the Senior Director, other Senior Managers and supervised Managers, responsible for the fair and efficient and “in the best interest of Amtrak” management and disposition of personal injury claims made to the company, the company’s claims against third parties and related litigation.
• Responsible with supervised Managers, Deputy General Counsel, Senior Director and tort litigation attorneys for regular case status and strategy reviews with outside counsel.
• Works with Senior Manager Claims Training Process Assurance & Peer Review in developing and keeping current Claims’ training programs, peer review program for Claims offices and functions, and overseeing the fair, efficient and effective resolution of claims against Amtrak and Amtrak’s Rolling Stock and other property damage claims, and also Claims process assurance program to ensure consistent application and implementation of Claims policies, processes, protocols and practices.
• Ensures offices and staff are working with Amtrak Health Services and Amtrak’s Senior Manager, Right Care Day One (RCD1) and external medical services to support availability of robust and responsive medical support resources and, where appropriate, transitional work, for injured claimants.
• Oversees offices and staff’s interface and coordination with inside counsel and outside counsel pursuant to applicable Law Department policies on Claims matters and tort litigation requiring counsel.  In this capacity, works with Senior Director and Deputy General Counsel with responsibility for tort litigation and his staff and outside counsel.
• With guidance from the Senior Director, develops with other Claims Senior Managers and Managers goals and metrics for Claims staff annual performance review program.
• Works with Senior Director and Claims Senior Business Services Specialist on development and management of Claims group budget for each fiscal year and to ensure uniform implementation within Claims group of all Amtrak and Law Department policies, processes, protocols and practices.
• Works with Senior Director and Claims Senior Business Services Specialist to ensure that Claims data base and other Claims group systems and applications are working, kept current, accessible to and appropriately used by all Claims staff and with other Senior Managers, advises Senior Director about the need for data base, system or application enhancement.
•    Supports Senior Director in her work with Chief Safety Officer and others (including Federal Railroad Administration staff and other railroads’ personnel) to advance safety and accident prevention policies, programs, processes, practices and initiatives across Amtrak operations and services.
• Travels within and outside of assigned territory. 
• Responds to accident sites, as needed, during the day, evening and night to include participation with Amtrak’s Incident Response team. 
• Perform duties in office and non-office settings (including administrative duties, attendance at trainings, conferences, visits to courthouses and attorney offices, visits to shops, facilities and other Amtrak offices).
• Occasional work away from home, weekends, holidays, odd days and/or shifts may be required. 
• When requested or assigned by the Senior Director, represents Amtrak Claims group within railroad industry and at conferences concerning the management and adjustment of and litigation concerning personal injury claims and property claims.
• Ability to exercise discretion while working and communicating in confidential settings with sensitive information.


• BA/BS degree or equivalent work experience
• Substantial experience handling and managing tort claims and litigation and coordinating with inside counsel and outside counsel on same, preferably in a railroad environment.
• Familiarity with applicable federal and state laws, rules of evidence, court rules to support responsibilities and work with inside and outside counsel productively for the company of Federal and State court rules and procedures sufficient to assure compliance by the corporation.
• Excellent interpersonal skills.
• Experience in supervision of personnel and management of functions and offices.
• Experience demonstrating skill and practice teaching and leading, mentoring and managing others with differing levels of expertise.
• Experience demonstrating skill communicating orally and in writing to people at various levels within and outside of the organization sufficient to exchange information, work cooperatively, facilitate understanding, and persuade and influence others.
• Ability to proficiently use Microsoft Office Suite. 
• Experience demonstrating skill formulating and executing strategies for handling tort claims and lawsuits.
• Experience demonstrating skill directing complex investigations through staff by way of recorded/written statements, scene photography, detailed interviews of witnesses, background information, search of medical history and other investigative techniques.
• Experience demonstrating skill managing and conducting settlement negotiations.
• Experience demonstrating skill creating, defining and implementing corporate policies for the handling and disposition of claims/litigation.
• Experience demonstrating skill granting appropriate settlement authority through proper case evaluation.
• Experience demonstrating skill examining accident causation trends and patterns from a risk management perspective sufficient to help other departments develop and maintain effective risk management standards.
• Experience demonstrating skill selecting, evaluating, advising and directing outside counsel in the handling of litigation matters sufficient to assure competent representation and protection of company interests.
• Experience demonstrating sufficient knowledge of tort law including FELA, complex claims investigations, case evaluation and settlement negotiations to supervise Claims staff and outside counsel and make business decisions.
• Working knowledge of contracts and agreements with vendors, freight railroad and commuter agencies sufficient to assure compliance with indemnity obligations.
• Experience demonstrating knowledge of Force Account, Railroad Protective and other insurance policies sufficient to assure coverage that will protect the corporation’s interests.
• Experience in progressively responsible supervisory positions including middle management.
• Ability to ensure effective caseload management and litigation support to minimize risk to Amtrak while controlling claims costs, legal fees and expenses.


• AIC, ARM or other advance industry program certificates
• Proficient in Microsoft Office 365
