SUMMARY OF DUTIES:
Responsible for the management and delivery of Delivery and Commercial Strategy services for the Capital Delivery organization (CAPD). This includes architecture, engineering, construction, and consulting (e.g., project management, construction management, delivery partner) contracts. Understands, supports, and furthers business and strategy of CAPD and other internal stakeholder departments in relation to project Delivery Strategy and Commercial Strategy. Oversees capital programming and project/program prioritization in support of annual operating plans and 5-year plans.

 

ESSENTIAL FUNCTIONS:

  • Provide persistent management and supervisory oversight to a diverse staff of project delivery and commercial/contracting professionals, including both senior and junior level personnel.
  • Works collaboratively with Amtrak Law and Procurement teams to ensure contracts and procurements are compliance with applicable laws and regulations, including FAR, across the CAPD portfolio.
  • Directs, manages, and oversees project development and delivery strategy to ensure that project and/or program scope, cost and schedules are properly developed, packaged, and procured and maintained from concept to execution planning.
  • Acts as a subject matter expert to provide strategic advice and analysis resulting in delivery methodology selection (e.g., DBB, CMAR/CMGC, DB, PDB, P3, Alliance, Delivery Partner) and commercial term development.
  • Proactively analyzes, monitors, and tracks contract and delivery performance to capture lessons learned and improve future project delivery and commercial strategies and minimize risk.
  • Supports resolution of complex contract and commercial inquiries and negotiations during the pre-procurement and procurement phases regarding risks, issues, contract obligations and revisions needed to General Provisions and other contract/commercial documents on CAPD projects.
  • Supports development of training for CAPD COTRs, project managers and commercial managers regarding change management, negotiations, alternative project delivery methods, commercial savvy and other project delivery and contract management functions.
  • Provides consulting services to support contract development, contract negotiations (as needed) and synthesizes recommendations to company leadership for decision making purposes. Supports the development of contract language for alternative delivery procurements in accordance with latest regulatory regulations/requirements. Supports selection plan development with Procurement and Project Delivery teams.
  • Collaborates closely with General Counsel and Procurement and Supply Chain teams to advance commercial terms and finalize agreements with contractors, consultants, suppliers, and vendors ensuring that commercial terms and contract agreements are aligned and approved.
  • Develop solutions for alternative delivery agreements that meet the needs of both internal and external stakeholders and Amtrak and ensure that alternative delivery commercial language and incentive structures are structured to align with budget requirements.
  • Ensures that standard offering documents are updated and contain all business requirements that are aligned with Amtrak needs and that all stakeholders are aligned on contract requirements and scope of work deliverables.
  • Works with Engineering Services, Project Development and Planning Services, and Project Delivery, Procurement and Supply Chain, and Legal offices to ensure compliance with Amtrak procurement policies while developing commercial language for procurement of all contractor and engineering services necessary to deliver capitally funded projects.
  • Supports solicitation development activities for all alternative delivery contracts to ensure the appropriate contract vehicle is established to meet the execution requirement of the CAPD office in charge. Ensures procurement documents are developed to align with Business Case, Project Charter, and Project Management Plan recommendations.
  • Supports pre-award activities to ensure source selection plan, evaluation criteria, solicitation amendments, pre-proposal conferences, and question clarification responses are appropriate, timely, and provide value to Amtrak. Collaborates with Procurement and Supply Chain team to ensure evaluation criteria is developed according to industry best practice and Amtrak procurement requirements. Maximizes contractor and designer procurement participation by supporting market analysis/outreach as well as ensuring that all bid questions are responded to appropriately and completely.
  • In conjunction with CAPD Project Delivery Teams, Procurement & Supply Chain team and other stakeholder groups, develops, disseminates, and implements best practices for evaluating and selecting project delivery methods.
  • Develops, maintains, and implements standard specifications (Division 1) and commercial terms and conditions.
  • Applies understanding of surety market conditions and project characteristics to determine appropriate payment and performance bond requirements. Secures waivers of Federal Railroad Administration requirements as needed. Monitors conditions nationwide to ensure that delivery methods and commercial terms and conditions are appropriate for the market in which a project will be undertaken to ensure robust competition and that Amtrak is viewed as the “Owner of Choice”. · Analyzes entire Amtrak Capital program to identify optimal project/program packaging strategies.
  • Work with Project Delivery Teams, Engineering Services, Service Delivery and Operations, Strategy & Planning, Finance and Amtrak leadership to support the development of the 5-year capital plan and Annual Operating Plan, including development of polices, processes and procedures for project chartering, budgeting, programming, and prioritization of projects based on need, readiness, and availability of funds.
  • Provides guidance, direction, motivation and supports staff training and development to ensure team in appropriately motivated and engaged on delivery strategy and commercial strategy deliverables.
  • Communicates and works closely with departmental peers and executives across functional areas to build delivery strategy and commercial strategy influence and set appropriate policies and direction.
  • Leverages best practices and makes decisions based on the best interests of Amtrak.
  • Proactively engages all the relevant internal parties in cross-functional activities to achieve shared goals and metrics to achieve success.
  • Effectively creates and uses written material, oral presentations, and verbal interchange, and be at ease working with business leaders and executive staff.
  • Regularly reports out progress and significant developments to senior management.
  • Interfaces directly with end-users, suppliers, Amtrak senior leadership, attorneys and government agencies as needed.
  • Development and mentoring of direct reports and team members is a critical aspect of this position.
  • Attends and actively participates in planning meetings and report on project status.

 

MINIMUM QUALIFICATIONS:

  • Bachelor’s degree in engineering, construction management, law, business or project management or a closely related field
  • 13+ years of experience in capital project and program delivery progressive growth and increased responsibility in providing major project delivery services to the public
  • In lieu of education a minimum of 17 years of relevant work experience, or equivalent combination of education, training, and work experience is needed
  • 5+ years of senior management-level experience at the department-head level in project/construction management, engineering and/or maintenance within passenger railroads, or in any comparable public or private organization
  • Understanding of construction, engineering/architecture, and consultant contractual instruments including project and program delivery methods (e.g., DBB, CMAR/CMGC, DB, PDB, P3, Alliance, Delivery Partner), contract type and terms & conditions.
  • Ability to effectively promote the integration of corporate-wide and departmental strategies and operating objectives and be able to develop and implement comprehensive delivery and commercial strategies consistent with corporate programs & objectives.
  • Ability to establish appropriate methods and procedures to effect efficient and accurate control of contract commitments and schedules including cost reduction programs to accomplish system-wide savings.
  • Extensive knowledge and experience in the field of project delivery, construction procurement, commercial strategy, contract administration, and contract management.
  • Extensive experience in the development, prioritization, and management of budgets for large (multi-billion dollar) capital programs consisting of several hundred projects using federal and other funding sources.
  • Demonstrated experience with alternative delivery construction contracts (e.g., DBB, CMAR/CMGC, DB, PDB, P3, Alliance, Delivery Partner).
  • Experience negotiating and administering various contract types of varying sizes and types of agreements within the architecture, engineering, and construction industry. 
  • Able to build constructive and effective relationships and use them to maneuver through complex situations.
  • Mastery of critical thinking/problem solving, written and verbal communication, business acumen, and decision-making abilities.
  • Ability to provide subordinates with guidance, direction, motivation, and training to ensure cost-effective acquisitions, good negotiating strategies, value-analysis techniques, in-depth market research of market trends, and new contract administration and negotiation techniques.
  • Ability to effectively manage in a fast-paced environment with frequently changing priorities.
  • Demonstrated experience with contract and commercial language development.
  • Demonstrated experience in developing contract incentive language.
  • Embraces learning new tasks, both complex and simple, to maintain effectiveness in this position.

PREFERRED QUALIFICATIONS:

  • Knowledge of Federal Acquisition Regulations and other government regulations
  • Graduate degree in engineering or project management, or JD and extensive experience working with construction of capital projects in an operating environment
  • Extensive project management experience
  • Proven record of accomplishment of improving business processes and delivering measurable results
  • Demonstrated experience with business development and/or market research/analysis
  • Demonstrated experience with contract language development on government procurements
  • Demonstrated experience in developing contract incentive language for complex alternative delivery projects
  • CMAA Certified Construction Manager (CCM) and/or PMI Project Management Professional (PMP) credential

 

WORK ENVIRONMENT:

  • Office environment: however, candidate will need to attend field visits and meetings across the country
  • Must be willing to come into the office at least 3 days per week
  • 25% travel requirement

The salary/hourly range is $187,500-$242,892. Pay is based on several factors including but not limited to education, work experience, certifications, etc. Depending on an employee’s assigned worksite or location, Amtrak may consider a geo-pay differential to be applied to the employee’s base salary. Amtrak may offer additional incentive and pay programs to recognize and reward our employees, including a short-term incentive bonus based upon factors such as individual and company performance that is commensurate with the level of the position and/or long-term incentive plan compensation.
